1.
Ownership of the landed property including the buildings thereon rests
with the foundation. The applicant residents will have the right of
residence together with the use of facilities only , as a licensee
without any rights of ownership. No non vegetarian food is permitted
within the Complex; so also, occupants are not allowed to share or
consume any alcoholic drinks within the Complex.

Applicant Residents will have the residential right for 20 years
renewable for a further period of 20 years on mutual consent. When the
flat is no longer required, it will revert to the foundation and the
amount of refundable deposit will be refunded as per the provisions of
the license agreement Applicant resident shall also have the right to
nominate his right to reside and avail the facilities to a person who
shall be a close blood relation who should also be a senior citizen
subject to the approval of the foundation. Close blood relation is
defined as one who is his son/daughter/grandson, grand daughter and none
others.

The refund shall be regulated by the provisions contained in the license
agreement. A brief outline of its salient features in the license
agreement are as follows:
a.
Initially the deposit paid will have a lock-in- period of 2 years during
which time the deposit will not be refunded.
b.
An additional amount of Rs.25000/ will be collected from the residents
at the time of occupation as a corpus fund for the maintenance of the
infrastructure which will be refunded at the time of termination of the
lease in accordance with the terms of the licence agreement. In case of
escalation of cost in maintenance and their charges of the
establishment, this corpus deposit will be increased suitably to keep
with times.
c.
The deposit amount is subject to escalation from time to time based on
inflationary situation and additional unforeseen charges, if any.
d.
All maintenance will be done by the Foundation and residents will not be
allowed to repair or make any alteration.
e.
The foundation shall be the deciding authority on all matters affecting
the property and various facilities therein..
f.
An agreement format of which is given here under, is to be executed by
the residents with the foundation at the time of registration of the
application
g.
The foundation will have the final say on accepting or rejecting the
application without assigning any reason whatsoever
The following in-house facilities
are part of maintenance of the establishment:-
House-keeping of all rooms & toilets and all common areas on daily
basis with periodic spraying of pesticides and other pest controls.
(Assistance for washing clothes would be provided at cost).
All maintenance
expenses, Municipal taxes etc. would be charged at cost . Based on
present cost of living (June,2009), it works out to about Rs.1,500/-
per occupant This is in addition to the Food Expenses and other
direct costs like electricity bill, telephone bill, transportation costs
which you have utilized, laundry charges etc.
